Acceptance
By placing your reservation, you accept these Terms and Conditions as a binding contract between Moto Hobo LLC (aka Moto Hobo Tours & Rentals, and referred to as Us and We) and you, the tour participant (also referred to as you, customer or client). When your reservation is received, you will be sent a preferences form to detail your dietary, smoking and room sharing needs. Every attempt will be made to accommodate your preferences and special requests. Please read and understand these Terms and Conditions carefully.

Release and Waiver
Every tour participant of a tour operated by Moto Hobo is required to accept and sign a release and waiver of rights form before the start of the tour. Moto Hobo will not accept any tour participant without a duly signed release and waiver form. A copy of this form will be sent to you prior to the start of the tour.

Agents and Representatives
Moto Hobo's agents and representatives represent Moto Hobo but are not a party to this contract. Nor are they responsible for failure to provide any service as may be described in our literature or descriptions from our web site pertaining to the contract.

Reservations and Deposit
For the tour a booking deposit of $500 is required at the time of booking. This deposit secures a place on the tour. The balance is due 30 days prior to the start of the tour. If the balance is not received 30 days prior to the tour, Moto Hobo reserves the right to treat this reservation as cancelled and charge the cancellation fee.

Motorcycle Rental and Security Deposit
Rental motorcycles can be provided as part of the tour package. Our current inventory includes late model touring BMWs. The pictures and descriptions on our web site or in our literature may not accurately represent the exact version of the motorcycle provided. Current inventory includes side cases. Ask us for more detailed information. We reserve the right to substitute the motorcycle confirmed to tour participants. We will strive to provide the motorcycle you are confirmed on. Unfortunately, certain unexpected and uncontrollable situations arise which may require the substitution of a motorcycle. This includes but not limited to, mechanical failure, damage and theft. Should we not be able to replace a confirmed motorcycle with the confirmed type or similar, a pro-rated refund for the difference in models will be refunded to tour participant. This constitutes the maximum liability of Moto Hobo LLC.

A security deposit must be paid at the time of check-out of the motorcycle at the beginning of the rental period. The amount of this security deposit is $2,500 or less if participant elects our Collision Damage Waiver (see Rental Terms & Conditions). We reserve the right to modify this amount without notice. The security deposit will be refunded upon the safe, undamaged return of the rental motorcycle to Moto Hobo. The rental period is not interrupted due to the inability of a renter to ride or for any other reason. During the tour, Moto Hobo is not obliged to replace a damaged motorcycle.

Your Own Motorcycle
When a tour participant rides his/her own motorcycle for use on our tours, no motorcycle insurance is provided by Moto Hobo.

Included in the Price
Typically, prices include overnight accommodations in double, twin or single rooms, morning and evening meals and entrance fees to attractions or museums. Additional fees may be required for special requests or accommodations.

Room Allocation
A limited number of single rooms may be available on a first come, first served basis but cannot be guaranteed. Moto Hobo will attempt to find a roommate for riders not specifying single room on their preferences form, but cannot guarantee it. Surcharges may be rquired for single room preference.

Excluded From Tour Price
All items not mentioned as included and all items of a personal nature or special request.

Baggage
Moto Hobo assumes no responsibility for loss, damage or delay in delivering baggage to tour participants. Baggage turned over to Moto Hobo each day for transport is done so at participant's own risk. Baggage insurance is recommended and is available from a number of providers found on our Links page. A maximum of two pieces of luggage are allowed for each particpant.

Cancellations and Refunds
Cancellations received more than 30 days prior to departure will be subject to a $200 per person calcellation fee. Cancellations received less than 30 days prior to departure will be subject to a fee of 1/2 of the cost of tour. No exceptions will be made to this policy for any reason. Trip cancellation insurance is available from a number of providers and can be found on our Links page.

Minimum Tour Participants
Moto Hobo reserves the right to cancel any tour if 30 days prior to departure an insufficient number of partipants have fully paid by that time.

Tour Cancellation
In this case, the customers will be immediately notified. Moto Hobo will offer to operate the tour if all customers agree to a supplemental charge due to the low number of participants. If customer does not accept the supplemental charge, Moto Hobo will refund their payment in full, which will constitute the full settlement. Moto Hobo is not responsible for any additional costs, expenses or losses incurred by the tour participant due to our cancellation of the tour due to lack of participants. This includes but is not limited to , pre-paid airline tickets, hotel reservations and automobile rentals. Situations may arise which, in our opinion, make it necessary for us to cancel, advance or postpone a scheduled tour, change iteneraries or make substitutions regarding hotels, cities, tour guides and other travel arrangements. In that event, we do not assume any responsibility or liability for any resulting losses, expenses or inconvenience. Moto Hobo is not required to make refunds once tour begins regardless of the reason for participants who are unable to complete his/her tour.

Non-Observance of Traffic Laws and Group Riding Regulations
If the customer does not comply with traffic laws or the requirements for group riding, the contract may be cancelled by Moto Hobo and the rental motorcycle secured.

Photo and Viedo Materials
Photos and videos produced by Moto Hobo or its representatives on tour are the property of Moto Hobo. The copyrights rest with Moto Hobo. Moto Hobo can use all of this material for advertising and marketing purposes including images in which the tour participant appears, without any charge from the tour participant arising for Moto Hobo for the use of this material.

Passport, Visa, Driving and Health Regulations
The tour participant is responsible for complying with all passport, visa, driving and health regulations and all consequences resulting from non-compliance.

Responsibility
Moto Hobo is responsible for providing the services listed in the tour descriptions in our literature and web site according to the local standard. Moto Hobo carefully selects and constantly checks its contractors such as hotels and restaurants. Moto Hobo is responsible for conscientious travel preparations. Moto Hobo is not responsible or liable for accidents. Moto Hobo reserves the right, without prior notification, to withdraw any part or all of a tour, to make such changes as may be necessary, and the additional costs, if any, resulting from these changes, shall be paid by the customer. Furthermore, it is agreed and understood that the owners, operators, agents and representatives, contractors of this tour including Moto Hobo are not the guardians of any tour participant's safety and they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or the customer's participation in connection with the tour, which might result in injury, death or other damage to the customer, his property, or his family, heirs or assigns. The liability of Moto Hobo as the tour operator is limited to a total of three times the tour price regardless of the title or claim. Moto Hobo is not responsible for any delays, changes in schedule or other conditions.

Alterations to Tour Schedule
If seasonal variences and/or weather conditions cause changes in the tour routing or accommodations, the itenerary will be adjusted accordingly and alternate hotels, restaurants and roads may be used.

Weather Conditions
Moto Hobo strives to schedule its tours during the time of year when weather conditions are favorable for motorcycle travel. Even so, weather conditions can change quickly and significantly. Moto Hobo cannot be made liable for unpleasant or unsuitable riding conditions and no refunds will be made for such conditions. Moto Hobo encourages all of its tour participants to wear appropriate protective riding gear at all times including rain gear if necessary.

Tour Rates and Rental Rates
Fares quoted in our literature and on our web site are in effect at the time of printing. If costs for hotels, meals, insurance, rentals, attractions, etc. dictate the need for fare increases, Moto Hobo may do so at any time up until 30 days prior to tour departure.

Insurance
Moto Hobo recommends that you secure any necessary travel insurance, health insurance, trip cancellation insurance, baggage insurance, etc. Providers of these types of insurance coverage may be found on our Links page.

Verbal Changes
All changes to this contract are invalid unless confirmed in writing.

Errors
Moto Hobo reserves the right to correct any printing errors or calculation mistakes at any time.
